These General Terms and Conditions govern online sales carried out through the website https://allstric.com/ (hereinafter “the website”), owned by RODAM SOLUTIONS S.L., with registered office at Avinguda de Agramunt nº 58, 25200 Cervera (Lleida), CIF B19790203, registered in the Commercial Registry of Lleida, Page L-35884, IRUS 1000423774058.

Any person who accesses and makes a purchase on this website shall be considered a consumer and user. As a prerequisite to providing any data, it is essential that you expressly accept these General Terms and Conditions. Accordingly, the consumer and user is advised of the need, convenience and importance of carefully reading and understanding these General and Specific Conditions, as well as any others on the Website, before accepting them. Acceptance of these General Terms and Conditions implies that the user has carefully read, understood and expressly accepted all its terms and conditions.

2. PURPOSE

Allstric®, the commercial brand of RODAM SOLUTIONS S.L., sells tools and accessories for vehicle care and maintenance, aimed at non-professional users who wish to maintain or repair their car independently, without the need to go to a workshop.

Each product available on the website includes its parameters, characteristics and specific conditions. Product descriptions and images are for guidance only. RODAM SOLUTIONS S.L. accepts no responsibility for information not directly prepared by it. RODAM SOLUTIONS S.L. does not provide technical advice regarding vehicle care or maintenance.

3. ACCESS TO AND USE OF THE WEBSITE

The website provides users with free access. To complete any purchase process, it is necessary to provide personal data, expressly accepting these terms and the Privacy Policy.

The website content is intended for all users over 18 years of age. The user assumes responsibility for proper use of the portal and undertakes not to use the content to engage in unlawful activities.

RODAM SOLUTIONS S.L. reserves the right to make, without prior notice, any changes it deems appropriate to its website, and may change, remove or add products, prices, offers or availability.

4. PURCHASE PROCESS

1. The user selects the products they wish to purchase and adds them to the shopping cart.

2. The user proceeds to the checkout, where they enter their personal data, shipping address and payment method.

3. Before confirming the order, the user may review the full summary: products, price including VAT and applicable shipping costs, and the data provided for billing and shipping the order.

4. By confirming the order and making the payment, the user finalizes the purchase and expressly accepts these General Terms and Conditions.

5. RODAM SOLUTIONS S.L. will send an order confirmation to the email address provided. The sales contract is concluded at that time.

6. Once the purchase has been made, a reference code will be displayed and will also be sent by email for order tracking.

Each delivery requires prior acceptance of these General Terms and Conditions by ticking the corresponding box during the purchase process.

5. PRICES AND TAXES

All prices published on the website are final prices and include the applicable Value Added Tax (VAT) in accordance with current Spanish legislation. Users shall not have to pay any extra amount to any third party to use the purchased product.

If any discount applies, it will be clearly shown and itemized. Shipping costs are detailed separately and must be accepted by the user before proceeding to checkout.

RODAM SOLUTIONS S.L. reserves the right to change prices at any time. However, the order will be invoiced at the price in force at the time of confirmation.

6. PAYMENT METHODS

The accepted payment methods are:

·         Bank card (Visa, Mastercard, Visa Electron and other similar cards) via Shopify Payments, a secure payment gateway with PCI DSS certification.

·         PayPal.

The card used for payment must be valid and have an expiration date more than 90 days away, to ensure that any refund can be processed, since for security reasons any refund will only be made to the same card used for the purchase; under no circumstances will a refund to a different destination be authorized.

Payment will be made at the time the order is confirmed. RODAM SOLUTIONS S.L. does not store data relating to the payment method used by the user; these are managed entirely by the secure payment gateways contracted.

If the user wishes to obtain an invoice for the purchased product, they must expressly provide their tax details. It may be requested later by sending an email to hola@allstric.com with the name, NIF/CIF and order number.

7. PRODUCT AVAILABILITY

All items on the website are permanently in stock, unless expressly stated otherwise. In the unlikely event that, after an order has been confirmed, any product is unavailable, RODAM SOLUTIONS S.L. will inform the user by email and/or phone to offer an alternative or proceed with a full refund of the amount paid.

8. SHIPPING AND DELIVERY

Products are shipped exclusively to the shipping address provided by the customer when making the purchase. Please check that the address is correct before confirming the order.

RODAM SOLUTIONS S.L. ships to mainland Spain and the Balearic Islands. The usual handling time is 1 to 2 business days from payment confirmation. The estimated delivery time is an additional 2 to 4 business days. Delivery times indicated for each product may vary due to logistical reasons or force majeure. In the event of a delay, users will be informed as soon as it becomes known.

The user must check the goods are in good condition in the presence of the carrier at the time of delivery. If any issue is detected (missing, damaged or unusable products), it must be noted on the carrier’s delivery note and reported to RODAM SOLUTIONS S.L. as soon as possible via hola@allstric.com. Claims for transport damage, missing items or incorrect delivery will not be accepted if the issue has not been properly reported within the established period and/or if the product shows obvious signs of having been tampered with.

Each delivery shall be deemed made from the moment the carrier makes the product available to the user. RODAM SOLUTIONS S.L. is not responsible for the delivery policies of the carrier company; in case of disagreement with the delivery process, the user must file a claim with the carrier company. Deliveries will not be considered completed when the outer packaging of the order shows obvious signs of damage.

9. RIGHT OF WITHDRAWAL

In accordance with current regulations, the user has the right to withdraw from the contract without giving any reason within 14 calendar days from the date on which the user, or a third party designated by them, has received the product.

To exercise the right of withdrawal, the user must notify it before the indicated deadline by contacting RODAM SOLUTIONS S.L. via hola@allstric.com. For detailed information on the process, conditions and possible exceptions, please refer to the Returns Policy.

In certain cases, given the nature of the products, exceptions to the right of withdrawal may apply. The user will be informed of these exceptions in the specific product conditions where applicable.

10. PRODUCT WARRANTY

All products sold by RODAM SOLUTIONS S.L. are subject to the legal three (3) year warranty of conformity from delivery, in accordance with Royal Legislative Decree 1/2007 as amended by Royal Decree-Law 7/2021, applicable to products purchased from January 1, 2022 onward.

If the defect becomes apparent during the first two years from delivery of the goods, it is presumed to be an original defect and the consumer does not need to prove anything for the warranty to apply. After that period, the manufacturer or seller may require the consumer to prove that the fault existed from the outset.

In the event of lack of conformity, the user may request repair or replacement of the product, a price reduction or termination of the contract, in accordance with current regulations.

The warranty will not apply in the following cases:

·         If the purchase receipt details are modified, altered or replaced.

·         If the warranted product is tampered with or repaired without prior notice to customer service.

·         If the purchase receipt and delivery note are not retained.

·         If the user has not used the product normally or has not followed the manufacturer’s instructions.

11. LIABILITY

RODAM SOLUTIONS S.L. shall not be liable for any decisions made by the user as a result of the information contained on the website. Photographs or videos relating to the products are for guidance only. RODAM SOLUTIONS S.L. does not guarantee the absolute accuracy of photographs and illustrations.

RODAM SOLUTIONS S.L. shall not be liable for damages arising from improper use or use contrary to the product instructions, nor for errors caused in delivery when the address provided by the user is incorrect.

RODAM SOLUTIONS S.L. reserves the right not to accept commitments offered or advertised by third parties that do not correspond to official company campaigns.

12. GENERAL PROVISIONS

RODAM SOLUTIONS S.L. will pursue any breach of these conditions by exercising all civil and criminal actions that may apply.

If there are discrepancies between what is established in these General Terms and the specific conditions of a particular product, the latter shall prevail.

If any provision of these Terms is declared void or unenforceable, the remaining terms shall continue in full force and effect.

14. CHANGES AND VALIDITY

RODAM SOLUTIONS S.L. may modify the conditions set out herein at any time, with the changes duly published on the website. These General Terms and Conditions shall remain in force for as long as they are displayed and not modified.

15. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals of the user’s domicile when the user has the status of consumer, in accordance with consumer and user protection regulations, expressly waiving any other jurisdiction that may apply to them.
